Agreement to these terms

By visiting shopessai.com or placing an order, you agree to these Terms & Conditions. If you don't agree, do not use the site.

These terms apply to all visitors, customers, and anyone else who accesses or uses our site. We may update them from time to time — when we do, we'll post the revised version here with an updated date. Your continued use of the site after any update constitutes acceptance of the new terms.

Products

Description accuracy: We describe our products as accurately as possible. Colors and textures may appear differently on different screens. Product images are representative — actual colorways may vary slightly based on monitor calibration and photography lighting. Physical product dimensions and specifications are as listed on the product page.

Availability: Product availability is not guaranteed at the time of purchase. ESSAI reserves the right to cancel any order placed for a product that becomes unavailable after checkout. In the event of cancellation, we will issue a full refund to your original payment method.

Pre-launch / waitlist: Being on our waitlist does not constitute a purchase, a reservation, or a guarantee that a product will be available to you at launch. Waitlist members receive early-access notification; actual purchasing opportunity depends on product availability at the time of release.

Pricing and payment

Prices: All prices are listed in US dollars. We reserve the right to change prices at any time and without prior notice. Price changes do not apply retroactively to orders that have already been confirmed.

Pricing errors: If a product is listed at an incorrect price due to a typographical error, system error, or data migration issue, we reserve the right to cancel any order placed at that incorrect price and to refund the amount charged. We will notify you promptly if this occurs.

Payment: We accept major credit and debit cards through Shopify Payments (processed by Stripe). By providing payment information, you represent that you are authorized to use the payment method provided. We do not store card numbers — payment processing is handled by Stripe.

Order confirmation: An email confirming receipt of your order does not constitute acceptance of your order. Your order is accepted, and a contract between us is formed, when we ship the item and send you a shipping confirmation.

Taxes: Applicable sales tax will be calculated and added to your order at checkout based on your shipping address.

Shipping

Processing time: Orders are processed within 1–3 business days from the date of purchase (excluding weekends and holidays). Processing time is separate from shipping transit time.

Shipping transit: Transit time varies by destination and shipping method selected at checkout. Estimated delivery dates shown at checkout are estimates, not guarantees.

Carriers: We ship via USPS, UPS, FedEx, and/or other carriers as available. Carrier selection may vary based on package size, destination, and availability.

Risk of loss: Title and risk of loss for all products pass to you upon delivery of your order to the carrier. We are not responsible for carrier delays, losses, or damage once a package is in transit.

Address errors: We are not responsible for orders that are delayed, undeliverable, or lost due to an incorrect or incomplete shipping address provided at checkout. If a package is returned to us due to an address error, we will contact you about reshipping. Reshipping costs may apply.

Alaska, Hawaii, and US territories: Shipping to Alaska, Hawaii, Puerto Rico, and other US territories is available but may involve longer transit times and different shipping rates than the contiguous US.

Returns and refunds

Return window: We accept returns within 90 days of the delivery date shown in your tracking confirmation.

Eligible condition: Items must be unworn, unwashed, and returned with original tags attached. Items that show signs of wear, washing, or damage are not eligible for return.

How to start a return: Contact us via Contact · shopessaiclothing@gmail.com with your order number and the item(s) you'd like to return. We'll send you a prepaid return label and instructions within 2 business days.

Refund processing: Refunds are processed within 10 business days of receiving your return at our facility. Refunds are issued to your original payment method.

What's refunded: The full purchase price of the returned item(s). If you paid for shipping at checkout (e.g. on an expedited service), the shipping fee is not refunded.

Exchanges: We do not offer direct exchanges at this time. If you'd like a different size or colorway, start a return for the original item and place a new order.

Damaged or incorrect items: If you receive an item that is damaged, defective, or not what you ordered, contact us via Contact · shopessaiclothing@gmail.com within 14 days of delivery. Include your order number and photos of the issue. We'll arrange a replacement or full refund at no cost to you.

Final sale: Items marked "final sale" at the time of purchase are not eligible for return or refund.

Intellectual property

All content on shopessai.com — including the ESSAI name, logo, wordmark, product designs, photography, copy, and visual assets — is owned by ESSAI and protected by US copyright and trademark laws.

You may not reproduce, distribute, modify, display, or create derivative works from any ESSAI content without our written permission. Linking to our site for non-commercial purposes is permitted.

Prohibited uses

You agree not to use the site to:

• Violate any applicable law or regulation
• Transmit spam, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or infrastructure
• Collect or harvest user data from our site without permission
• Use automated tools (scrapers, bots) to access or extract site content
• Resell or commercially redistribute products purchased from us without prior written authorization
• Engage in any activity that disrupts or interferes with the proper functioning of the site

We reserve the right to terminate access to the site for any user who violates these terms.

Disclaimer of warranties

The site and its content are provided "as is" without any warranty, express or implied. ESSAI does not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

Our products carry the standard of quality described on each product page. Beyond what is explicitly stated, ESSAI makes no representations regarding merchantability or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by applicable law, ESSAI's total liability to you for any claim arising from your use of the site or your purchase of products is limited to the purchase price you paid for the specific item giving rise to the claim.

ESSAI is not liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, loss of data, or business interruption — even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on implied warranties or exclusions of certain types of damages, so the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless ESSAI, its owners, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the site, your violation of these terms, or your violation of any third-party rights.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Texas for any dispute arising from these terms or your use of the site, except as otherwise provided under Dispute resolution below.

Dispute resolution

Informal resolution: Before filing any claim, you agree to contact us via Contact · shopessaiclothing@gmail.com and give us 30 days to try to resolve the issue. Most concerns can be resolved this way.

Binding arbitration: If informal resolution fails, any dispute arising from these terms or your purchase will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Texas or, if you prefer, by phone or video. You waive any right to a jury trial and waive any right to participate in a class-action lawsuit or class-wide arbitration.

Small claims: Notwithstanding the above, either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies under that court's rules.

Entire agreement

These Terms & Conditions, together with our Privacy statement and Cookie policy, constitute the entire agreement between you and ESSAI regarding your use of the site and your purchases. They supersede any prior agreements or understandings.
